I believe the FCC has reallocated that band to Martime Moble is why they are called "illegal". But as long as you are careful to not cause any interference there's no real reason not to use them. Only the old wireless mics that operate in the 600Mhz bands are really shunned by the FCC.

What's the status of legally being able to use VHF wireless mics? I've got an older AudioTechnica that runs at 169.505 MHz that I want to install at another station I work with, and am wondering if it's even legal to use any more?
