I have a client who is on a tower that was not properly lit for several months.  He has made multiple attempts to get the owner I(a medium size company with headquarters a couple of states away) to fix the lights.  He contacted the FAA every 15 days and turns in a NOTAM just to keep himself out of liability with the FAA and FCC...  a pain but is a great legal move.

Hence along came the FCC tower registration which put most of the lighting liability back on the structure owner.

Even though most of the burden of tower lighting and paint now falls to the structure owner, I believe that the individual licensee's are still liable to some extent in the case that the structure owner fails to maintain proper lighting and/or paint.

I can't quote any specific cases but recall an occasion or two where all licensee's on a tower received stern letters from the FCC and/or FAA just to get a negligent tower owner's attention from several directions.
