Randy,

You are correct, the FCC will give specify the allowable power range construction permit.  If you need a waiver that can benefit from the reduced power, you can use the "anticipated" power in those requests by using an alternative maximum power, such as the 42W maximum power that could be authorized at 150 ft (46 m) HAAT.  (See https://www.fcc.gov/media/radio/fmpower)

I'm thinking that the FCC issues the lesser power when they issue the license, and not us when we submit the minor mod.  Am I correct?
